End-User License Agreement (EULA)

This End-User License Agreement (the "Agreement") is a binding contract between you (the "Licensee") and BneuTech ("BneuTech", "we", "us"). By downloading, installing, activating, or using any BneuTech software product, including any Expert Advisor, indicator, utility, or accompanying file (collectively, the "Software"), you agree to be bound by this Agreement.

1. License Grant

Subject to the terms below and full payment of all fees, BneuTech grants you a personal, non-exclusive, non-transferable, revocable license to install and run the Software on the number of MetaTrader 5 accounts authorised by your purchase. You may not sublicense, lease, distribute, share, resell, or transfer the Software to any third party.

2. Restrictions

You may NOT:

• copy, decompile, disassemble, or reverse-engineer the Software, in whole or in part;
• remove, modify, or obscure any copyright, trademark, watermark, version string, or attribution;
• use the Software to develop, market, or distribute a competing product;
• share account credentials, license keys, activation codes, or installer files;
• use the Software for any unlawful purpose or in violation of any prop firm, broker, or platform terms.

3. Ownership

The Software is licensed, not sold. BneuTech retains all right, title, and interest in and to the Software, including all intellectual property rights. No rights are granted other than those expressly stated in this Agreement.

4. Trading Risk Disclosure

Trading in foreign exchange, contracts for difference (CFDs), commodities, indices, and other leveraged financial instruments involves substantial risk of loss and is not suitable for every investor. The Software is a tool to assist with risk management and execution; it is not investment advice and does not guarantee profit, the passing of any prop firm challenge, the avoidance of drawdown, or compliance with any specific firm's rules. Past performance, including back-tested or simulated results, does not predict or guarantee future results. You are solely responsible for every trade placed on your account, whether automated or manual. See the full Risk Disclaimer below.

5. Prop Firm Rule Compliance

BneuTech does not represent or guarantee that the Software will keep your account compliant with any prop firm's rules (including but not limited to FTMO, MyForexFunds, The5ers, FundedNext, or any other firm). Rule sets, audit procedures, and enforcement vary by firm and by phase, may change without notice, and may include manual review steps that no software can predict. You are responsible for reading and following the rules of your prop firm at all times. Any reference to a firm name, phase or evaluation type in the Software or marketing material is provided for guidance only and is not endorsed by, affiliated with, or sponsored by the named firm.

6. No Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. BneuTech does not warrant that the Software will be free of bugs, errors, or compatibility issues with any specific broker, server, MetaTrader 5 build, or operating system.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BneuTech, its affiliates, directors, employees, contractors, and licensors SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF TRADING CAPITAL, FAILED PROP FIRM CHALLENGES, MISSED OPPORTUNITIES, BROKER REJECTIONS, EXECUTION DELAYS, SLIPPAGE, OR DATA LOSS, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE SOFTWARE, EVEN IF BneuTech HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The total aggregate liability of BneuTech under this Agreement shall not exceed the amount you paid for the Software in the twelve (12) months preceding the claim.

8. Refunds

Because the Software is a digital product that can be activated and deployed immediately on multiple accounts, all sales are final and non-refundable except where mandated by applicable consumer-protection law or where the platform of purchase (e.g. MQL5 Market) provides a refund mechanism that we are bound by. If you experience a defect that prevents the Software from running, contact support within 7 days of purchase and we will work to resolve it.

9. Updates and Support

BneuTech may, at its discretion, release updates to the Software. Major version updates may require a new license. Email and Telegram support are provided on a best-effort basis during ordinary business hours. We do not guarantee response within any specific time frame.

10. Termination

BneuTech may terminate this Agreement and revoke your license immediately if you breach any term. On termination, you must cease all use of the Software and remove every copy from every system. Sections 3, 4, 5, 6, 7, 8, 11, 12, and 13 survive termination.

11. Indemnification

You agree to indemnify, defend, and hold harmless BneuTech and its affiliates from and against any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of or related to your use of the Software, your trading activity, or your breach of this Agreement.

12. Governing Law

This Agreement is governed by the laws of the jurisdiction in which BneuTech is established, without regard to its conflict-of-laws rules. Any dispute shall be resolved in the courts of that jurisdiction, and you submit to their exclusive jurisdiction.

13. Entire Agreement

This Agreement is the complete and exclusive understanding between you and BneuTech regarding the Software and supersedes all prior or contemporaneous communications, whether written or oral. If any provision is found unenforceable, the remaining provisions remain in full force and effect.

Risk Disclaimer

1. No Investment Advice

BneuTech is a software vendor. We are not a registered financial adviser, broker, dealer, money manager, signal provider, or fund. Nothing on this website, in any of our software products, in any chat, video, blog post, email, Telegram channel, or social-media post constitutes investment, financial, legal, tax, or accounting advice. All content is provided for informational and educational purposes only.

2. No Guarantee of Profit

BneuTech does not guarantee, promise, imply, or otherwise represent that you will earn money, recover losses, achieve any specific return, or pass any prop firm challenge by using our software. Profit/loss outcomes depend on market conditions, broker execution quality, slippage, latency, spread, swap, news events, account size, leverage, your discretionary inputs, and many other factors outside our control. Past performance, including back-tested, simulated, or live results, is not indicative of future results.

3. Hypothetical & Simulated Performance

Hypothetical or simulated performance results have inherent limitations. They are prepared with the benefit of hindsight, do not represent actual trading, do not involve financial risk, and cannot account for slippage, partial fills, broker rejections, or the psychological impact of real losses. Our included Prop Firm Simulator is designed for stress-free practice and education; outcomes there will not necessarily match live trading.

4. Prop Firm Rule Compliance — User Responsibility

BneuTech software includes optional risk-management features (daily-loss guards, drawdown shields, combined open-risk and margin-usage caps, news filters, etc.) intended to assist with rule-compliant trading. These features are tools, not guarantees. Prop firm rules — including those of FTMO, MyForexFunds, The5ers, FundedNext, and any other firm — change without notice and are interpreted at the firm's sole discretion. You are solely responsible for staying compliant with the rules of your prop firm at all times. BneuTech accepts no liability for any account violation, breach, ban, withheld payout, or termination of your prop firm account.

5. No Affiliation

References in our software or marketing to third-party platforms or firms (FTMO, MyForexFunds, The5ers, FundedNext, MetaQuotes, MetaTrader 5, FBS, Pepperstone, etc.) are nominative only. We are not affiliated with, endorsed by, sponsored by, or partnered with any of these firms unless explicitly stated.

6. Technology Risks

Automated trading depends on a chain of systems — MetaTrader 5 terminal, VPS or local computer, internet connection, broker server, liquidity provider, exchange. Failure or latency at any link can cause missed entries, missed exits, partial fills, requotes, slippage, or unintended exposure. BneuTech is not responsible for losses caused by such failures.

7. Acknowledgement

By installing, activating, or using BneuTech software, you acknowledge that you have read this Risk Disclaimer in full and that you accept full and sole responsibility for every trading decision and every outcome on your accounts.

Privacy Policy

1. Information We Collect

We collect only what we need to deliver and improve our software:

• Order data: name, email, billing address, payment confirmation. Payments are processed by MQL5 Market or our payment provider; we do not store full card numbers.
• Support communication: any message you send us through the contact form, email, or Telegram, plus the email address you sent it from.
• Activation data: account number(s) you authorise the software to run on, used solely to enforce license limits.
• Server logs: standard web-server logs (IP, user-agent, page, timestamp) for security and analytics.

2. How We Use It

• To deliver, license, support, and update our software.
• To respond to your support requests.
• To send important product or security notices (no marketing without your opt-in consent).
• To detect, prevent, or investigate fraud, license abuse, or unlawful activity.

3. Telegram Integration

If you enable Telegram alerts in our software, your bot token and chat ID are stored locally on your machine. The software sends messages directly from your machine to Telegram's servers; BneuTech does not see, store, or proxy these messages.

4. Sharing

We do not sell your data. We share data only with: (a) our payment processor and platform of sale (e.g. MQL5 Market) as required to complete your purchase; (b) hosting and email-delivery providers strictly as needed to operate this site; (c) legal authorities when required by law.

5. Cookies

This site uses only essential cookies and may use privacy-respecting analytics. No third-party advertising or behavioural-tracking cookies are set.

6. Your Rights

You may request access, correction, or deletion of your personal data through the contact page. We will respond within a reasonable time. If you are in the EU/UK, you have additional rights under GDPR/UK-GDPR including the right to lodge a complaint with your local data-protection authority.

7. Retention

We retain order and support data for as long as needed to provide the service and meet legal/accounting obligations, then we delete or anonymise it.
